Possession Proceedings are legal proceedings brought by a mortgage lender when there has been a Default on a Mortgage. The proceedings seek an order from the Court granting possession to the lender (and ejecting the registered proprietor or other occupier from the property). Possession Proceedings enforcing a Registered Mortgages are brought in the Common Law Division (and are known as Ejectment Proceedings). Possession Proceedings for an unregistered mortgage are brought in the Equity Division and require judicial orders for sale (as there is no statutory power).
