CBA v Mastros [2008] NSWSC 616

The borrower sought to set aside default judgement and file a Contracts Review Act defence. Justice Hall noted that the mortgage had been used to refinance an existing debt thus even if the borrower won he would still have to pay back what was refinanced. As the borrower could not pay that sum into Court the judgment was not disturbed and the bank was entitled to evict.
