ANZ v Soliman [2014] NSWSC 1008

The lender was granted possession and the borrower sought a stay on the basis that it had obtained refinance and the lender was protected.

The court noted that the offers of refinance were no more than indicative approvals conditional upon a number of matters and only discharged the debt if the figures were taken at their highest. The court noted the hardship created to the young family but did not think refinance possible and refused the stay.
